10.03 Lack of unity of invention may be directly evident “a priori,” that is, before considering the claims in relation to any prior art, or may only become apparent “a posteriori,” that is, after taking the prior art into consideration. For example, independent claims to A + X, A + Y, X + Y can be said to lack unity a priori as there is no subject matter common to all claims. In the case of independent claims to A + X and A + Y, unity of invention is present a priori as A is common to both claims. However, if it can be established that A is known or obvious (see Chapter 13 for guidance on obviousness), there may be lack of unity a posteriori, since A (be it a single feature or a group of features) is not a technical feature that defines a contribution over the prior art.

PCT INTERNATIONAL SEARCH AND PRELIMINARY EXAMINATION GUIDELINES (as in force from July 1, 2020)

하나의 출원 안에 다수의 발명이 들어가 있다는 거절이 Lack of Unity of Invention 입니다. 미국 특허 출원에서도 그런 거절을 자주 받는 편이 아니고, 받는다 하더라도 Restriction Practice가 거의 비슷하기 때문에 특별히 어려운 점은 없었습니다.

최근에 PCT의 ISR (International Search Report) / WO (Written Opinion)을 분석할 일이 있었는데 그 중 한 케이스에서 “a posteriori” Lack of Unity of Invention 거절이 들어가 있더군요.2020년 7월 1일 버젼 PCT INTERNATIONAL SEARCH AND PRELIMINARY EXAMINATION GUIDELINES 를 통해서 그게 무슨 내용인지 파악할 수 있었습니다.

“A priori” (before) 뜻은 선행기술을 청구항과 비교해보기 이전에 이미 다수의 발명이 출원에 포함되어 있다고 판단할 수 있는 경우입니다. 즉 청구항들이 A+X, A+Y, X+Y 라는 그룹으로 나눠진다고 심사관이 판단되는 경우, 그 청구항들 모두에 공통으로 포함되어 있는 subject matter 가 없으므로, Lack of Unity of Invention 이 됩니다.

“A posteriori” (after) 뜻은, 청구항들이 A+X, A+Y 그룹으로 분류될 수 있어서, A 라는 공통의 subject matter가 있으나, 선행기술을 적용해 보니, A가 신규(novel)한 것도 아니고, Inventive step이 있는 것도 아니어서, A를 없다고 쳐보니, X 와 Y 전혀 다른 두 개의 subject matter가 남는다, 따라서 Lack of Unity of Invention 라고 판단한다 라는 것입니다.
